Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of phitality.com (the “site”) and any purchase you make through it. In these Terms, “Phitality”, “we”, “us” and “our” mean Phitality, PO Box 1640, Liberty, MO 64069, United States, and “you” means the person using the site or placing an order.

By using the site or placing an order, you agree to these Terms. If you do not agree to them, please do not use the site. If you have any questions, contact us at support@phitality.com.

1. Our products

Phitality sells plasma and frequency wellness instruments, including Theraphi and Quantaphi, along with related furniture, accessories and printed materials. Our products are designed in Canada and assembled in Canada and the United States.

Health and medical disclaimer. Our products are experimental wellness instruments intended for education and research. They are not medical devices. They are not intended to diagnose, treat, cure or prevent any disease or illness, and nothing on this site is medical advice or a substitute for it. These statements have not been evaluated by the U.S. Food and Drug Administration. Always seek the advice of a qualified healthcare professional before using any wellness technology, and especially if you are pregnant, have an implanted electronic device such as a pacemaker, or have a diagnosed medical condition.

2. Orders and acceptance

Product listings on the site are an invitation to buy, not an offer. When you place an order you are making an offer to purchase, and a binding contract is formed only when we send you an order confirmation by email. We may decline or cancel an order before that point — for example, if an item is unavailable, a price or description was shown in error, or we are unable to verify your details.

Some products are made to order or produced in limited runs. Where that is the case, lead times are shown on the product page or confirmed by email.

3. Prices and payment

Prices are shown in US dollars and exclude shipping and any taxes or duties, which are calculated at checkout or charged on delivery. Payment is processed through Shopify’s checkout and its payment processors; we do not receive or store your full card details. For high‑value instruments we may offer payment by wire transfer, in which case your order is held and dispatched once funds have cleared. If a price is listed in error, we will contact you before dispatch so you can confirm the corrected price or cancel for a full refund.

4. Shipping and delivery

We ship from Liberty, Missouri in the United States, and Canadian orders ship from our warehouse in Canada. We aim to process orders the same or next business day; please allow 24–72 hours for tracking updates, and note that during peak periods processing can take up to two weeks. Standard domestic delivery by USPS Priority or UPS Ground typically arrives within 2–3 business days. US customers may select expedited overnight shipping, which is prioritized and delivers the next day (orders placed on a Friday arrive the following Monday).

Theraphi orders ship via FedEx domestically and internationally; other products ship via UPS or USPS domestically and DHL or UPS internationally, depending on the option selected. Delivery timescales are estimates, not guarantees, and we are not responsible for delays caused by carriers, weather or customs.

A signature is required for all deliveries of Phitality technology. If a delivery is missed, any redelivery cost is the customer’s responsibility. Risk in the goods passes to you on delivery. Please inspect your order on arrival and contact us promptly, with photographs, if anything has arrived damaged. Full details are in our Shipping Policy, which forms part of these Terms.

5. International orders

For orders shipped outside the United States, duties, import taxes and VAT are not included in the price and are not collected by us. You are responsible for paying these charges on receipt, and for ensuring the product may lawfully be imported and used in your country. Phitality is not liable for these charges, and refused or abandoned deliveries are refunded net of shipping and any costs we incur.

6. Returns

Because our products are specialized, often made to order, and high in value, all sales are final and we do not offer returns or refunds for change of mind. Please contact us at support@phitality.com before ordering if you are unsure whether a product is right for you. Faulty products are handled under our warranty, described below and in our Product Warranty and Return Policy, which forms part of these Terms.

7. Warranty

Our warranties cover manufacturing defects only. They do not cover damage from misuse, modification, neglect, water damage, dropping, accidents or improper setup, and they are not transferable between owners.

• Theraphi amplifier and coil — 5‑year warranty against factory defects, covering parts and labor.
• Theraphi tubes — 1‑year warranty. Replacements within the first year are covered where a photograph or video confirms that a replacement is needed.
• Quantaphi — 1‑year warranty for manufacturer defects only. It does not cover damage from improper setup, dropping or user error.

To make a warranty claim, contact us first at support@phitality.com. Items sent in for warranty service are shipped at the customer’s expense; our returns department will troubleshoot the item on receipt to determine eligibility, and we will decide whether to repair or replace it on a case‑by‑case basis.

8. Safe use

Theraphi and Quantaphi are high‑voltage plasma instruments. You agree to follow the setup and safety guidance supplied with the product and published on this site, including keeping coils, tubes and lead wires clear of the body, metal, conductive surfaces and flammable materials while the device is in operation. You are responsible for the safe installation and use of the product in your home or practice, and for any use of it with other people.

9. Practitioners and resale

Owning a Phitality product does not make you our agent, employee, distributor or representative, and does not license you to use our brand except as we permit in writing. If you offer sessions to clients, you do so on your own account and at your own risk, and you are responsible for your own insurance, licensing and compliance. Replacement glass tubes are sold only to existing Theraphi and Quantaphi owners.

10. Affiliate program

Participation in our affiliate program is governed by these Terms and by the program terms shown when you apply. We may approve or decline any application, and may withhold commission on orders that are canceled, refunded, or found to be fraudulent or self‑referred.

11. Your conduct on the site

You agree to provide accurate information when you order or contact us, and not to misuse the site — no scraping, no attempts to interfere with its operation or security, and no unlawful or infringing content submitted through our forms or comments. We may remove content, and refuse or withdraw access to the site, where these Terms are breached.

12. Intellectual property

All content on this site — text, images, video, designs, logos, and the Theraphi and Quantaphi names — belongs to Phitality or our licensors and is protected by copyright and trademark law. You may view and share it for personal, non‑commercial use. You may not copy, republish or use it commercially without our written permission. If you send us a review, comment, testimonial or photograph, you grant us a non‑exclusive, royalty‑free license to use it in our marketing, and you confirm that it is your own and accurate.

13. Testimonials and results

Any testimonials or results described on the site are individual experiences and are not a promise or guarantee of the results you will achieve. Results vary from person to person.

14. Third‑party links and services

The site links to third‑party sites and services we do not control, including our practitioner locator and social channels. We are not responsible for their content, products or privacy practices, and listing a practitioner is not an endorsement or a guarantee of their services.

15. Limitation of liability

To the fullest extent permitted by law, Phitality is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue or data, arising from your use of the site or a product. Our total liability for any claim is limited to the amount you paid for the product concerned. Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded, and some states do not allow certain exclusions, so parts of this section may not apply to you.

16. Indemnity

You agree to indemnify us against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of a product, or your provision of sessions or services to others.

17. Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these Terms.

18. Changes to these Terms

We may update these Terms from time to time. The version that applies to your order is the one published on this page when you place it, and we will update the effective date above whenever we make a change.

19. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict‑of‑law rules. You and Phitality agree that the state and federal courts located in Missouri have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the site. If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force.
