Phitality (“Phitality”, “we”, “us” and “our”) makes plasma and frequency wellness technology, including Theraphi and Quantaphi. This Privacy Policy explains what personal information we collect through phitality.com, why we collect it, who we share it with, how long we keep it, and the choices and rights you have.

1. Information you give us

We collect the information you provide directly when you use the site:

  • When you place an order: your name, billing and shipping address, email address, phone number, and the items you order. Checkout is operated by Shopify. Your card details are processed directly by Shopify’s payment processors — we never see or store your full card number.
  • When you contact us: your first and last name, email address, phone number, and the subject and contents of your message.
  • When you apply to our affiliate program: your name, email address, phone number, city, state, website, and any social media profiles you choose to share.
  • When you subscribe to our newsletter or ask to be notified when a product is back in stock: your email address.

2. Information we collect automatically

When you visit the site, we and our service providers automatically collect certain information through cookies and similar technologies: your IP address, device and browser type, the pages you view and how long you spend on them, and the website or advertisement you arrived from. We use this to keep the site working, to understand how it is used, and to measure our marketing.

3. How we use your information

  • To take payment, fulfill and ship your order, and to handle returns and warranty claims.
  • To answer your questions and provide customer support.
  • To send you marketing emails where you have asked to receive them — you can unsubscribe from any of them at any time.
  • To operate and pay out our affiliate program.
  • To understand how the site is used, to measure our advertising, and to improve our products and services.
  • To keep the site secure, detect and prevent fraud, and enforce our Terms and Conditions.
  • To meet our legal, tax and accounting obligations.

If you are in the United Kingdom or the European Economic Area, the legal bases we rely on are: performance of a contract (to process your orders and provide support), your consent (for marketing emails and non-essential cookies), our legitimate interests (to secure and improve the site, prevent fraud, and understand how our products are received), and compliance with a legal obligation.

4. Who we share your information with

We do not sell your personal information for money. We share it only with the service providers that make the site and the business work, and only as needed for them to perform their service:

  • Shopify — our store, checkout and payment processing.
  • Payment processors engaged through Shopify — to take and secure your payment.
  • Webflow — website hosting.
  • StoreSynk (Shopyflow) — connects our website to our Shopify store so products, cart and checkout work.
  • Our email marketing provider — to send our newsletter and back-in-stock notifications.
  • UpPromote — affiliate program tracking.
  • Stockist and Google Maps — our practitioner locator.
  • Google Analytics — to measure how the site is used.
  • Meta (Facebook and Instagram) — to measure and deliver our advertising.
  • Shipping carriers — to deliver your order.
  • Google reCAPTCHA — to protect our forms from spam and abuse.
  • Skynet Technologies (All in One Accessibility) — to provide the accessibility toolbar on our site.

We may also disclose information where the law requires it, to respond to lawful requests from public authorities, to enforce our agreements, or to protect the rights, property or safety of Phitality, our customers or others. If our business is involved in a merger, acquisition or sale of assets, your information may be transferred as part of that transaction; we will notify you of any such change.

5. Where your information is processed

We are based in the United States and our service providers are located primarily in the United States. If you access the site from the United Kingdom or the European Economic Area, your personal information will be transferred to, and processed in, the United States. Where it is, we rely on the European Commission’s and the UK’s Standard Contractual Clauses, or another safeguard approved under applicable law, to protect it.

6. How long we keep your information

We keep your personal information only for as long as we need it for the purposes described in this policy. In practice:

  • Order and transaction records are kept for as long as needed to provide warranty support and to meet our tax and accounting obligations under United States law — generally up to seven years.
  • Marketing contacts are kept until you unsubscribe or ask us to delete them.
  • Support enquiries and affiliate applications are kept for as long as needed to handle your request and the relationship, and are then deleted.

When we no longer need your information, we delete it or anonymize it.

7. Your choices and rights

You can unsubscribe from our marketing emails at any time using the link at the bottom of any message, or by emailing us. You can control cookies through your browser settings and, where offered, our cookie controls.

Depending on where you live, you may have the right to ask us to:

  • tell you what personal information we hold about you and give you a copy of it;
  • correct information that is inaccurate or incomplete;
  • delete your information, where we are not required to keep it;
  • transfer your information to another provider (data portability);
  • restrict or object to how we use it, or withdraw a consent you previously gave.

To make a request, email support@phitality.com. We will respond within the time required by the law that applies to you, and we may need to verify your identity first. You may use an authorized agent to make a request on your behalf. We will not treat you differently, or deny you products or services, for exercising any of these rights.

8. Your California privacy rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, gives you the right to know what personal information we collect and the purposes we use it for, to request access to it, to request that we delete or correct it, and to opt out of the “sale” or “sharing” of personal information for cross-context behavioral advertising.

We do not sell your personal information for money. We do use advertising cookies and the Meta pixel to measure and deliver advertising, which California law treats as “sharing.” You can opt out of this at any time by:

  • emailing support@phitality.com with the subject “Do Not Sell or Share My Personal Information”; or
  • enabling a Global Privacy Control (GPC) signal in your browser — we honor GPC signals as a valid opt-out of sharing for the browser and device on which they are sent.

We do not knowingly sell or share the personal information of consumers under 16. We will not discriminate against you for exercising any of your California rights.

9. Cookies and similar technologies

We use cookies that are strictly necessary for the site and checkout to work, and — with your consent where it is required — cookies that measure how the site is used (analytics) and that support advertising. You can control or delete cookies through your browser settings; if you block strictly necessary cookies, parts of the site, including checkout, may not work.

10. Children

Our site and products are intended for adults. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us with personal information, please email us and we will delete it.

11. How we protect your information

We use appropriate technical and organizational measures to protect your personal information, and payment data is handled by PCI-compliant payment processors. No method of transmission over the internet or method of electronic storage is completely secure, however, so we cannot guarantee absolute security.

12. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will change the “Last updated” date at the top of this page, and where the change is significant we will provide a more prominent notice, such as an email or a notice on the site. Your continued use of the site after an update means you accept the revised policy.
